These terms govern The Date Atelier Brand Partner Programme. Please read and retain them before applying. They apply when accepted as part of your approved participation, subject to the transition provisions below. Publication alone does not replace an existing partner’s accepted agreement or change commissions already earned.
1. Who operates the programme
The programme is operated by Yazid Haroun, trading as The Date Atelier (“the Atelier”, “we”, “us” or “our”). Contact us at hello@thedateatelier.co.uk for programme support, payment queries, complaints or requests for a copy of your accepted terms.
A “partner” is an applicant whom we have approved and whose partner account has been activated after acceptance of the applicable terms. The programme rewards eligible customer purchases introduced by partners. It is separate from our Refer a Friend programme, wholesale arrangements and Atelier Circle membership. Customer purchases remain subject to our applicable terms of sale, delivery and returns policies; personal information is handled under our Privacy Policy.
2. Eligibility and accurate information
You must be at least 18, legally able to enter this agreement and resident in a country in which we have confirmed that participation and payment are supported. Applying does not confirm that your country is supported. If you apply for a business, you must be authorised to represent it and identify its legal owner.
Provide accurate contact, residence, identity and payment information, and keep it up to date. We may request proportionate evidence to verify eligibility, identity, tax status or ownership of a payment account. You may hold only one partner account unless we agree otherwise in writing. Do not create duplicate accounts, use another person’s identity or share account credentials.
3. Application, review and activation
Joining is subject to application review and approval; submitting a form or creating a customer account does not automatically make you a partner. We aim to review complete applications within three days. Additional information or verification may take longer, and we will let you know if further information is needed.
We assess applications for suitability, genuine promotional activity, supported location and compliance with these terms. We may approve, request information or decline an application. Once approved, follow the activation instructions and accept the applicable partner terms. Partner commission is not earned before activation unless we have expressly agreed otherwise in writing. Use the same account email for your application and activation so that the records can be matched.
4. Free to join and independent participation
There is no joining fee, compulsory subscription, required stock purchase, personal purchase requirement or minimum sales target. No payment is made simply for applying, joining, inviting a partner or recruiting a team. Earnings arise only from genuine eligible customer sales.
You choose whether, when and how to promote the Atelier, subject to these terms and applicable law. You are an independent, non-exclusive participant, not authorised to bind the Atelier, collect customer payments on our behalf or make promises outside our published information. Nothing in this agreement removes rights arising from your actual legal status.
Participation does not guarantee sales, income, profit, a particular team size or recovery of your expenses. You are responsible for any promotional costs you choose to incur. Do not incur expenditure on the assumption that we will reimburse it without prior written agreement.
5. Your customer links and partner invitations
Your customer sharing link or QR code introduces people to our creations and enables an eligible introduction to be recorded. Your partner invitation link directs prospective partners to apply and records the inviting partner. These are different links for different purposes; a partner invitation is not an automatic approval or a commission-generating sale.
Use the links, codes and sharing tools issued to your account. A first name shown in a link or invitation is a presentation feature; the underlying unique identifier determines attribution. Do not edit identifiers, substitute another partner’s code, conceal the destination or use misleading redirects. You may share an individual creation or the collection where the provided tools support this.
6. Which purchases qualify
An eligible purchase is a genuine, paid retail purchase of qualifying products, correctly attributed under these terms, made while the relevant partner is active and eligible. Unless a specific written promotion states otherwise, commission applies to full-price qualifying products and there is no minimum order value for those products.
Commission does not apply to delivery or shipping charges, VAT or other sales taxes, customs duties, service fees, gift-card purchases, membership charges, wholesale or trade orders, complimentary goods, replacements, test orders, unpaid orders, cancelled orders or refunded amounts. Discounted product lines are excluded unless a published partner promotion expressly includes them. Mixed orders are assessed by eligible product line.
Redeeming a gift card as payment does not by itself exclude an otherwise eligible product purchase; commission must not be counted both when a gift card is bought and when it is redeemed. Your own purchases, purchases through an account you control and orders arranged primarily to manufacture commission are not eligible. A genuine purchase by a friend or relative is not automatically excluded, but must be for that customer’s own use or genuine gifting and must not be funded or reimbursed by you to generate commission.
7. Commission rates and calculation
Direct commission: 15%. You earn 15% of eligible product revenue from customers correctly attributed to you during their applicable attribution period.
First team level: 3%. Where eligible, you earn 3% of eligible product revenue from customer sales attributed to a partner you directly introduced.
Second team level: 2%. Where eligible, you earn 2% of eligible product revenue from customer sales attributed to a partner introduced by one of your direct partners. No commission is paid beyond these two team levels.
Eligible product revenue means the qualifying product amount actually paid and retained, after deducting any VAT or other sales tax actually charged and any refunds, with delivery and other excluded charges removed. The 15%, 3% and 2% rates are all applied to this same base. They are not applied to the VAT-inclusive price where VAT is charged, and team commission is not deducted from the direct partner’s 15%.
For example, if an eligible box costs £30 including £5 VAT, the commission base is £25. The direct partner earns £3.75, the eligible first-level partner £0.75 and the eligible second-level partner £0.50: £5 in total. Delivery is excluded. This example assumes VAT at 20%; it is not a statement that every sale is subject to that rate.
If we are not VAT registered or no VAT is charged on a particular sale, no notional VAT is deducted. The actual tax treatment of the sale determines the base. This approach continues to apply if our registration status or tax rates change.
The maximum combined commission under the standard rates is 20% of eligible product revenue. If a team level is missing or ineligible, its share is not redistributed, passed up the team or added to another partner’s share. Amounts are calculated in the transaction records and rounded to the nearest penny for each payable commission entry.
8. Your tax responsibilities
You are responsible for declaring your income and meeting your own tax, reporting and registration obligations. We may request tax information or an invoice where needed to make a lawful payment. We do not provide personal tax advice.
VAT on your promotional services is separate from VAT deducted from customer product revenue. Unless we agree otherwise in writing, stated commission payments include any VAT you are required to charge on your commission; an additional VAT amount is not automatically added. Tell us if you are VAT registered and provide the necessary invoice information. Self-billing will only be used under a separate compliant agreement where required.
9. Customer attribution and repeat purchases
A valid introduction must be recorded against the correct customer through our supported invitation, account or partner-code process. Customers should use the same account when returning so that eligible repeat purchases can be recognised. Sending a link, a screenshot or a verbal claim alone does not establish entitlement to commission.
The customer’s first qualifying purchase establishes the commission attribution period. Eligible repeat purchases remain connected to the recorded partner for 12 months from that purchase, subject to continued partner eligibility. This is not lifetime attribution and a new visit or repeat order does not restart the period.
Before attribution is established, a valid partner code deliberately supplied through a supported checkout or account process takes priority over a passive link visit. Once the customer’s attribution is established, another link or code does not overwrite it. Account creation or an invitation may preserve introduction information, but does not itself generate commission.
Tracking can be affected by a different email or account, device changes, blocked storage, a missing identifier or an incomplete invitation. We do not promise attribution from every click. We will review credible evidence of a genuine recording error under the next section.
10. Attribution queries and corrections
If an eligible introduction appears to be missing or incorrect, contact us promptly with the relevant partner code, approximate date and order reference where the customer has agreed to share it. Do not request a customer’s password, verification code or payment details. We may ask the customer to confirm the facts directly.
Our records are the starting point for review, not an absolute bar to correcting mistakes. We consider relevant timestamps, account and invitation records, customer confirmation and evidence of technical failure. We will not reassign an established customer solely because another person later claims the sale. A correction must address a genuine error and must not create duplicate rewards.
We will explain the outcome and any resulting adjustment. If you disagree, you may ask for a further review through the complaints process. No change overrides a customer’s privacy rights.
11. Partner teams
The inviting partner is recorded through the application process and confirmed when the applicant is approved and activated. Approval remains the Atelier’s decision. Applicants who do not identify an inviter are not automatically assigned to someone who later claims to have introduced them.
Team relationships cannot be bought, sold, transferred, rearranged or recreated through duplicate accounts to increase earnings. We may correct a genuine application error after reviewing evidence. No partner owns a customer, another partner or their personal information.
Team commission depends on genuine eligible customer sales and the relevant partners’ eligibility at the time of the sale. There is no payment for recruitment alone, application approval, headcount or a partner’s own purchase. A suspended or missing level does not cause the team to compress. Any review of earnings already accrued is handled under the investigation and payment provisions.
12. Separate referral and trade arrangements
The Brand Partner Programme is separate from Refer a Friend gifts and trade introductions. The same introduction or purchase cannot generate both a customer referral gift and partner commission unless a specific published promotion expressly allows it. You cannot retrospectively move a purchase between programmes to obtain an additional reward.
Wholesale, hospitality, corporate and other trade arrangements may have different prices and agreements. They do not generate standard partner commission unless we expressly confirm a separate arrangement in writing before the relevant sale.
13. Pending commission and validation
A recorded sale may initially show pending commission. It becomes available for payment only after payment has cleared, complete delivery has been confirmed, 10 days have elapsed after that delivery and any necessary eligibility or fraud checks have been completed. Dispatch alone does not confirm delivery. For split deliveries, the period starts after the final relevant delivery.
Pending amounts are estimates and may change following a cancellation, refund, payment dispute or correction. We may ask for proportionate evidence if delivery or payment cannot be confirmed. The validation period does not alter customers’ statutory rights or limit remedies available under our terms of sale.
14. Payment schedule and records
Available, undisputed commission is paid once a month, on the last day of the month, or the next working day if that date is not a working day. Commission is confirmed in your account after the 10-day period following confirmed delivery, subject to the payment and eligibility checks in section 13. It is then paid in the monthly payment run; there is no additional 30-day holding period. Amounts that become available after a run has been processed carry forward to the next monthly run. A working day excludes weekends and public holidays in England. Pending amounts carry forward until eligible.
Provide valid payment details in your own name or the approved business’s name, together with any required verification and invoice information. No minimum payout threshold applies under these standard terms. Amounts are not forfeited merely because they are below a preferred payment amount or have remained unpaid while correct details are being obtained.
Payment can be delayed by missing information, a banking failure, a legitimate dispute or a proportionate compliance review. We will explain the reason and the steps needed to resolve it. Your records should distinguish pending, available, held, reversed and paid amounts; an amount is not treated as paid merely because a transfer has been scheduled. Bank processing times may delay receipt after transfer.
15. Refunds, chargebacks and overpayments
Commission is reduced or reversed where the corresponding product revenue is refunded, cancelled, charged back or found ineligible. A partial product refund produces a corresponding adjustment to the eligible revenue and each affected commission. A refund of delivery alone does not reduce commission because delivery was excluded from its base.
If affected commission has already been paid, we may offset the evidenced overpayment against later commission or request repayment, explaining the calculation. We will not take an automatic debit from your bank account under these terms. You may dispute an adjustment and provide evidence. If a payment dispute is resolved in our favour and the sale otherwise qualifies, the related commission will be restored.
16. Make advertising clear
Clearly identify promotional content and your financial relationship with the Atelier before someone engages with it. Use a prominent “Ad” disclosure where applicable; do not hide it after a link, among hashtags or behind a “more” button. A suitable example is: “Ad — I earn commission on qualifying purchases through this link.”
When inviting potential partners, explain that you may earn from eligible customer sales generated by partners in your team, not from their joining. A personal invitation or friendship does not remove the need for an appropriate disclosure. Follow applicable advertising rules and the rules of the platform you use.
17. Accurate, responsible promotion
Use current, approved product information. Do not invent ingredients, allergen assurances, certifications, availability, discounts or delivery promises. Do not make unsubstantiated nutritional, medical, health, weight-loss or superiority claims. Refer customers with allergy or product-suitability questions to our published information or the Atelier.
Do not publish fake reviews, pretend to be an independent customer, misrepresent your experience or make unsupported comparisons with other businesses. Do not promise earnings, guaranteed success, financial independence or a typical income without reliable evidence and our prior written approval. Commission examples explain arithmetic, not expected earnings.
Promote respectfully and lawfully. Do not exploit vulnerable people, pressure others to spend or join, harass recipients or use discriminatory, unlawful or misleading content. Correct or remove non-compliant material promptly when we reasonably request it.
18. Sharing, consent and advertising channels
Only send direct promotional messages where the recipient has requested or agreed to receive them and applicable marketing rules permit the message. Do not use purchased lists, scraped contact details, bulk unsolicited messages or automated spam. Providing a sharing tool does not give permission to contact someone or constitute their consent.
Do not upload another person’s details or enrol them without permission. Honour requests to stop contacting someone. You are responsible for any separate website, mailing list or promotional channel you operate, including its privacy, cookie and marketing obligations.
Paid advertisements, brand-keyword bidding, coupon or cashback sites, affiliate networks and similar distribution arrangements require our prior written approval. Do not register confusingly similar domains, impersonate our official accounts or imply that your channel is operated by the Atelier.
19. Brand materials and customer orders
While your account is active, we grant you a limited, non-exclusive, revocable permission to use the approved programme materials solely to promote the Atelier in accordance with these terms. Ownership of our names, logos, photographs and other materials remains with us or their respective owners. Do not alter them misleadingly or sublicense them.
You retain ownership of original content you create, subject to any third-party rights. Participation alone does not give us unrestricted rights to reuse your content; any broader reuse requires your permission or a separate agreement. You must have permission for people, music and third-party material included in your promotions.
Customers place orders directly with the Atelier. We handle acceptance, payment, fulfilment and customer service under our sales policies. You must not collect orders or payments in our name, vary our terms, issue refunds on our behalf or offer unauthorised guarantees.
20. Misuse, investigation and suspension
We may investigate suspected fraud, self-referral, duplicate accounts, fabricated sales, misleading promotion, attribution manipulation, repeated payment abuse or other material breaches. We may temporarily restrict relevant tools or hold affected commission where reasonably necessary to protect customers or investigate.
Our response should be proportionate to the issue. Where lawful and practical, we will explain the concern, identify the affected amounts, give you an opportunity to respond and provide updates. Unrelated, undisputed earnings should not be withheld solely because another transaction is under review. Holds will not continue indefinitely without a reason and review.
We may reverse ineligible amounts, require correction of content, suspend access or terminate participation where justified. You may challenge a decision through the complaints process. We may preserve necessary records and cooperate with lawful requests from authorities.
21. Privacy and account visibility
We use application, account, referral, purchase and payment information to administer the programme, attribute introductions, assess eligibility, prevent misuse and meet legal obligations, as described in our Privacy Policy. Programme participation does not automatically subscribe you or anyone you introduce to marketing.
Your account may display limited information needed to understand your own eligible customer sales and commissions, such as a first name, reference, relevant dates and commission status. Your team view may display partner names or identifiers, level and participation status. It does not entitle you to customers’ email addresses, phone numbers, payment details or unrestricted information about another partner’s customers.
Use information visible through the programme only for its permitted purpose. Do not export it into marketing lists, publish it or contact someone using information obtained solely through the programme without a lawful basis. Protect account access and notify us promptly of suspected unauthorised access.
22. Leaving or ending participation
You may leave at any time without a fee by contacting us. We may end participation ordinarily on at least 30 days’ notice, or sooner where required by law or justified by serious fraud, safety concerns or a material breach. Where a breach can reasonably be remedied, we will normally give an opportunity to correct it.
Ending participation does not automatically cancel valid commission already accrued. It remains subject to the ordinary validation, refund and payment provisions. Unless a written transition arrangement provides otherwise, purchases made after participation ends do not generate new commission. A 12-month customer attribution period is not a guarantee of future commission after lawful termination.
Stop using partner tools and brand materials after participation ends, except where retention is legally required. Keep records necessary for your tax obligations or a genuine dispute. Ending one partner’s participation does not automatically terminate other partners; team changes do not create an entitlement to redistributed commission.
23. Changes to the programme and these terms
We may update the programme to reflect genuine business needs, technical changes or legal requirements. We will normally give at least 30 days’ notice of a material adverse change, including a reduction in commission rates or a significant restriction on eligibility, and explain when it applies. Urgent changes may take effect sooner where necessary for legal compliance, security or prevention of material abuse.
We will not retrospectively reduce valid commission already earned. Existing accepted commitments will be honoured or addressed through an agreed, lawful transition. Where express acceptance is required, a website update alone will not be treated as acceptance. You may leave before a change takes effect.
VAT treatment follows the tax actually charged on each sale, as explained in section 7. VAT registration or a change in the applicable tax rate does not require the commission percentage itself to change. Any separate change to the percentage remains subject to these notice and transition provisions.
24. Responsibility and limits
We will administer the programme with reasonable care and skill. We cannot guarantee uninterrupted availability, every third-party platform’s operation or a particular commercial result. Tell us about an error so that we can investigate and take reasonable steps to correct it.
Neither party is responsible for losses that were not reasonably foreseeable when the relevant agreement was made. We do not accept responsibility for speculative future earnings or promotional expenditure we did not authorise. This does not exclude valid commission owing under these terms.
Nothing excludes or limits liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence, or any liability or statutory right that cannot lawfully be excluded or limited. An event outside our reasonable control may delay performance but does not automatically cancel an existing payment obligation.
25. Questions, complaints and governing law
Contact hello@thedateatelier.co.uk with your partner reference and a clear description of the issue. We aim to acknowledge complaints within five working days and provide a substantive response within 20 working days. If further investigation is needed, we will explain why and provide an update.
These terms are governed by the law of England and Wales, subject to any mandatory rights that apply in your place of residence. The courts of England and Wales have jurisdiction, without removing any right you may have to bring proceedings in another court under mandatory law. This agreement does not require compulsory private arbitration or restrict access to a regulator or competent authority.
26. Acceptance and existing partners
Before activation, read and accept the terms presented for your participation. We retain a record of the applicable terms and acceptance date. You may request a copy at any time. If one provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law; a delay in enforcing a right does not waive it.
For an existing partner, these published terms and the 15% direct rate do not silently replace an earlier accepted rate or agreement. We will communicate any required transition, effective date and acceptance process separately. Commission already earned remains governed by the terms applicable when it was earned.
